These Terms & Conditions (“Terms”) govern your access to and use of natures-serenity.com (the “Site”) and purchases from Nature’s Serenity, LLC, a Texas limited liability company (“Nature’s Serenity,” “we,” “us,” or “our”).
Please read these Terms before using the Site or placing an order. By accessing the Site, creating an account, submitting an order, or otherwise using our services, you agree to these Terms and to any policies incorporated into them by reference.
If you do not agree with these Terms, please do not use the Site or place an order.
1. Who You Are Doing Business With
All products offered through this Site are sold by Nature’s Serenity, LLC.
Any purchase, agreement, refund obligation, warranty obligation, or other transaction made through the Site is a transaction with Nature’s Serenity, LLC and not with any owner, member, manager, employee, or representative in an individual capacity.
Nothing in a transaction through this Site creates a personal guaranty by any member, manager, owner, employee, or representative of Nature’s Serenity, LLC.
Nothing in this section limits any right or remedy that cannot lawfully be limited.
2. Eligibility and Lawful Use
You must have the legal capacity to enter into a binding agreement to make a purchase through the Site. If you are under the age of majority where you live, a parent or legal guardian must make the purchase for you.
You may use the Site only for lawful purposes.
You may not use the Site to commit fraud, interfere with Site security or operation, obtain unauthorized access to information or systems, submit false payment or identity information, infringe intellectual-property rights, or engage in any activity prohibited by applicable law.
3. Our Products
Nature’s Serenity sells handcrafted and small-batch products, including candles, wax melts, home-fragrance products, and related merchandise.
Because many of our products are handcrafted and made using natural materials, individual items may have minor differences in appearance, wax texture, surface finish, color, wick appearance, label placement, or other non-functional characteristics.
These normal handmade variations are not considered defects when they do not materially interfere with the product’s intended use.
Product photographs are intended to represent our products as accurately as reasonably possible. However, lighting, photography, display settings, manufacturing variation, packaging changes, and other factors may result in minor differences between an image and the item received.
Advertised net quantity, product type, and other material product characteristics remain as represented on the applicable product page.
4. Fragrance and Scent Expectations
Fragrance perception is inherently subjective. The way a fragrance smells, its perceived strength, and how it performs in a particular room can vary based on personal sensitivity, room size, ventilation, temperature, fragrance preferences, and other environmental conditions.
Unless we expressly state otherwise, descriptions such as scent notes, strength, mood, atmosphere, or similar descriptive language are provided to help customers understand the intended fragrance profile and are not guarantees that every customer will perceive a fragrance in the same way.
A personal dislike of an accurately supplied fragrance does not by itself mean that the product is defective.
5. Product Safety and Proper Use
Candles, melted wax, fragrance products, and candle-warming equipment must be used responsibly.
By purchasing or using one of our products, you agree to follow all safety warnings, care instructions, product labels, and instructions supplied with the product or published by Nature’s Serenity.
Candles contain an open flame and hot wax. Never leave a burning candle unattended. Keep burning candles away from children, pets, drafts, combustible materials, and anything that may catch fire. Use candles on stable, heat-resistant surfaces. Do not handle or move a candle while the container or wax is hot. Do not use a candle with a damaged or cracked vessel. Trim and maintain the wick according to the instructions provided with the product.
Wax melts should only be used with an appropriate wax warmer and according to the warmer manufacturer’s instructions. Wax melts are not intended to be eaten, applied to the body, or exposed directly to an open flame unless the product and equipment are specifically designed for that purpose.
Our home-fragrance products are not food, medicine, cosmetics, or therapeutic products unless expressly identified otherwise.
If you experience irritation, sensitivity, or another adverse reaction that you believe may be associated with a product, discontinue use.
Nature’s Serenity is not responsible for loss or damage to the extent caused by misuse, negligent handling, unauthorized modification, use contrary to product warnings or instructions, or use of a product for a purpose for which it was not designed.
Nothing in these Terms excludes responsibility that cannot lawfully be excluded.
6. Burn Time and Product Performance
Any burn-time estimate or similar performance estimate displayed on the Site is an approximation rather than a guaranteed minimum unless expressly identified as a guarantee.
Actual performance may vary depending on wick maintenance, burn duration, room conditions, drafts, temperature, candle placement, and compliance with candle-care instructions.
7. Pricing and Product Information
We make reasonable efforts to keep product descriptions, prices, availability, photographs, promotions, and other Site information accurate.
Occasionally, typographical, technical, pricing, inventory, or other errors may occur.
If an obvious material pricing or listing error is discovered before an order is accepted or shipped, we may cancel the affected order or contact you for instructions. If we cancel an order after payment has been collected, the affected amount will be refunded to the original payment method.
We will not substitute a materially different product without appropriate notice or consent.
Packaging, labeling, or other non-material presentation details may change from time to time without notice.
8. Taxes
Applicable sales, use, or other transaction taxes will be calculated and collected when required by law.
Tax calculations may depend on the shipping destination, product type, transaction amount, and applicable tax rules.
9. Orders and Acceptance
Submitting an order constitutes an offer to purchase the products listed in the order.
An automated order-confirmation email acknowledges that we received your order but does not necessarily mean that the order has been finally accepted.
We reserve the right to refuse or cancel an order before fulfillment for legitimate reasons including inventory errors, obvious pricing errors, suspected fraud, unauthorized payment activity, abusive purchasing behavior, shipping restrictions, legal requirements, or circumstances that make fulfillment impracticable.
If we cancel an order after collecting payment, we will refund the appropriate amount to the original payment method.
We may establish reasonable quantity limits to protect inventory availability or prevent unauthorized commercial resale.
10. Payment
You agree to provide current, complete, and accurate billing and payment information.
Payments may be processed by third-party payment processors. Your use of a payment method may also be subject to the terms of your bank, card issuer, digital-wallet provider, or payment processor.
We do not ask customers to waive legitimate rights to dispute unauthorized or incorrect charges.
However, intentionally filing a false payment dispute, falsely claiming that an order was unauthorized, falsely claiming non-delivery, or otherwise abusing the chargeback process may constitute fraud.
When a payment dispute occurs, Nature’s Serenity may provide the payment processor, card issuer, financial institution, or other appropriate party with relevant transaction records, order information, delivery records, communications, policies, and other evidence reasonably necessary to respond to the dispute.
We encourage customers to contact us first when they believe an order or charge is incorrect so that we have an opportunity to resolve the issue promptly.
11. Fraud and Order Verification
To protect our customers and our business, we may review orders for indications of fraud or unauthorized payment activity.
We may request reasonable verification before fulfilling an order when an order presents a significant fraud risk.
We may cancel and refund orders that we reasonably believe involve stolen payment information, identity fraud, unauthorized transactions, intentional policy abuse, or other unlawful activity.
12. Shipping and Delivery
Shipping methods, current shipping charges, available destinations, free-shipping offers or thresholds, estimated processing times, and related conditions are described in our Shipping Policy and during checkout.
Our Shipping Policy is incorporated into these Terms by reference.
Customers are responsible for providing a complete and accurate shipping address.
If an order is returned to us because of an incorrect or incomplete address supplied by the customer, refusal of delivery, or another circumstance attributable to the recipient, additional shipping charges may be required before the order is resent.
If we make an addressing or fulfillment error, we will be responsible for correcting our error.
Carrier delivery estimates are estimates and may be affected by weather, holidays, transportation disruptions, carrier operations, emergencies, or other events outside our reasonable control.
When a shipment is delayed beyond a time we have promised, we will provide any delay notice, cancellation opportunity, refund, or other remedy required by applicable law.
If tracking indicates delivery but you cannot locate your package, contact us promptly. We may ask you to verify the delivery address, check the immediate delivery area, contact household members or neighbors, and cooperate with a carrier investigation.
A carrier delivery scan does not eliminate any customer right provided by applicable law.
13. Returns, Refunds, Damaged Items, and Cancellations
Returns, refunds, exchanges, damaged or defective merchandise, incorrect orders, and customer-requested cancellations are governed by our separate Returns & Refunds Policy, which is incorporated into these Terms by reference.
Please review that policy before placing an order.
If these Terms and the Returns & Refunds Policy address the same return- or refund-specific issue differently, the Returns & Refunds Policy controls for that issue unless applicable law requires otherwise.
Nothing in either policy affects a refund or other remedy that must be provided under applicable law.
14. Promotions, Discounts, and Free Shipping
Coupons, promotional codes, free-shipping offers, discounts, giveaways, and similar promotions may be subject to additional conditions stated with the promotion.
Unless expressly permitted, discounts may not be combined.
Promotions may have eligibility requirements, expiration dates, geographic restrictions, product exclusions, minimum-purchase requirements, or other reasonable limitations.
Any free-shipping threshold or offer will be applied according to the conditions displayed on the Site, in the Shipping Policy, or at checkout.
We may refuse or cancel transactions involving fraudulent use, duplication, manipulation, unauthorized publication, automated exploitation, or other abuse of promotional offers.
Changes to promotions do not affect orders that have already been accepted under a valid promotion.
15. Gift Cards and Store Credit
If Nature’s Serenity offers gift cards, promotional credit, or store credit, additional terms displayed when the credit is issued may apply.
Gift cards and store credit have no cash value except where redemption for cash is required by law.
Nothing in this section allows us to impose an expiration date or fee that is prohibited by applicable law.
16. Unauthorized Resale and Commercial Use
Purchasing products from Nature’s Serenity does not authorize a purchaser to represent themselves as an employee, representative, distributor, franchisee, partner, or authorized reseller of Nature’s Serenity.
Products may not be materially altered, relabeled, repackaged, or presented as a different product while continuing to use Nature’s Serenity trademarks or branding without our written permission.
Separate wholesale or commercial agreements, when applicable, may establish different terms.
17. Intellectual Property
The Site and its original content—including Nature’s Serenity names, logos, branding, photographs, product names, graphics, written descriptions, designs, website content, and other original material—are owned by or licensed to Nature’s Serenity, LLC and are protected by applicable intellectual-property laws.
You may use the Site for ordinary personal shopping and informational purposes.
You may not reproduce, copy, scrape, republish, sell, commercially exploit, imitate, or distribute protected Site content without permission except as allowed by law.
No purchase of a Nature’s Serenity product transfers ownership of our trademarks, copyrighted materials, branding, or other intellectual property.
18. Customer Reviews and Submitted Content
If you voluntarily submit a review, photograph, testimonial, comment, or other content to Nature’s Serenity, you represent that you have the right to submit that content and that it does not knowingly contain false, unlawful, defamatory, infringing, or fraudulent material.
You grant Nature’s Serenity a non-exclusive, royalty-free right to display and reproduce the submitted content in connection with our business and marketing, subject to applicable law and any additional permissions we specifically request.
We may moderate or remove submitted content for reasons such as spam, threats, unlawful material, disclosure of private information, intellectual-property infringement, irrelevant content, or abusive material.
We do not require a review to be positive merely because it is submitted through our Site.
19. Electronic Communications
By placing an order or contacting us electronically, you consent to receive transactional electronic communications necessary to service your order or respond to your request.
These communications may include order confirmations, receipts, shipping updates, customer-service messages, fraud-verification requests, cancellation notices, or refund information.
A purchase does not, by itself, require you to consent to unrelated promotional marketing communications.
20. Privacy
Our collection and use of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.
Payment information may also be processed by third-party payment providers according to their own privacy and security practices.
21. Third-Party Services and Links
The Site may use or link to services operated by third parties, including payment processors, shipping carriers, social-media platforms, analytics providers, and other service providers.
We are not responsible for the independent content, policies, security practices, availability, or conduct of third-party websites or services that we do not control.
This provision does not excuse Nature’s Serenity from obligations that applicable law places directly on us as the seller.
22. No Medical, Health, or Therapeutic Advice
Product names, scent descriptions, marketing language, customer reviews, educational content, or references to relaxation, atmosphere, comfort, serenity, mood, or similar concepts are not medical advice and are not representations that a product will diagnose, treat, cure, or prevent a disease or medical condition.
Customers should not use our products as substitutes for professional medical treatment.
23. Disclaimer of Certain Expectations
Except for express promises contained in an applicable product listing, written warranty, or store policy, we do not guarantee that a particular fragrance will meet an individual customer’s subjective preference, that every handmade product will be visually identical, or that a candle will perform identically in every environment.
We do not disclaim warranties or consumer protections that cannot lawfully be disclaimed.
24. Limitation of Liability
To the fullest extent permitted by law, Nature’s Serenity, LLC will not be liable for indirect, incidental, special, exemplary, or consequential economic damages resulting solely from use of the Site or a transaction with us when such damages may lawfully be limited.
For claims involving only economic loss arising from a particular order, and not involving personal injury, death, damage to other property, fraud, gross negligence, willful misconduct, or another category of liability that cannot lawfully be limited, our aggregate liability will not exceed the amount paid to Nature’s Serenity for the order giving rise to the claim.
This limitation does not apply where applicable law prohibits it or where applying it would unlawfully restrict a consumer remedy.
Nothing in these Terms is intended to exclude liability for personal injury caused by a defective consumer product where such liability cannot lawfully be excluded.
25. Customer Responsibility for Misuse
Customers are responsible for using products according to their intended purpose and provided safety instructions.
To the extent permitted by law, Nature’s Serenity is not responsible for damages caused by a customer’s intentional misuse, reckless handling, unauthorized alteration, failure to follow prominent safety instructions, or use of a product in circumstances that a reasonable person would recognize as unsafe.
Responsibility will be allocated according to applicable law where more than one party contributed to a loss.
26. Indemnification for Unlawful Conduct
To the extent permitted by law, you agree to indemnify Nature’s Serenity, LLC against third-party claims arising directly from your intentional unlawful use of the Site, infringement of another person’s intellectual-property rights through content you submit, fraudulent activity, or unauthorized commercial alteration or resale of our products.
This provision does not require a consumer to indemnify Nature’s Serenity for our own negligence, defective products, unlawful conduct, or obligations that applicable law places on us.
27. Events Outside Our Reasonable Control
We are not responsible for delays or temporary inability to perform caused by events outside our reasonable control, such as severe weather, natural disasters, transportation interruptions, carrier disruptions, labor disruptions, governmental actions, utility or network failures, emergencies, or similar events.
We will nevertheless comply with any cancellation, delay-notification, refund, or other rights required by applicable law.
28. Governing Law
These Terms and transactions with Nature’s Serenity, LLC are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where federal law applies or another jurisdiction’s non-waivable consumer protections must apply.
Nothing in these Terms is intended to deprive a customer of a consumer protection that applicable law does not allow the customer to waive.
29. Dispute Resolution and Venue
We encourage customers to contact us before beginning formal legal proceedings so that we have a reasonable opportunity to investigate and resolve a problem.
This informal-resolution request does not shorten or waive any legally applicable deadline or prevent a customer from seeking urgent relief when necessary.
Except where applicable law gives a consumer a non-waivable right to proceed elsewhere, any court action arising from these Terms or a transaction with Nature’s Serenity, LLC shall be brought in a court of competent jurisdiction serving Gillespie County, Texas, or in an applicable federal court with jurisdiction over the dispute.
Either party may use an appropriate small-claims court when the claim qualifies.
30. Severability
If any portion of these Terms is determined to be unlawful, invalid, or unenforceable, that portion will be enforced to the maximum extent legally permitted or severed when necessary.
The remaining provisions will continue in effect unless doing so would fundamentally defeat the purpose of the agreement.
31. No Waiver
If Nature’s Serenity does not immediately enforce a provision of these Terms, that does not permanently waive our right to enforce that provision later.
Similarly, nothing in these Terms constitutes a waiver by a customer of a right that cannot legally be waived.
32. Assignment
You may not transfer contractual rights or obligations arising from an order for purposes of fraud or avoiding these Terms.
Nature’s Serenity may assign its rights and obligations as part of a lawful sale, merger, restructuring, transfer of the business, or transfer to a successor entity, provided that doing so does not eliminate consumer rights that have already accrued.
33. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business, products, Site, or legal requirements.
The updated Terms will identify the date they were last revised.
Unless applicable law requires otherwise, changes apply prospectively. An order already placed is generally governed by the terms and policies applicable when that order was placed rather than materially different terms added afterward.
34. Entire Agreement and Related Policies
These Terms, together with applicable product information, safety instructions, our Privacy Policy, Shipping Policy, Returns & Refunds Policy, and any specific promotion or written agreement applicable to an order, constitute the agreement governing use of the Site and purchases from Nature’s Serenity.
Mandatory rights provided by applicable law take priority over conflicting contractual language.
